Agreed Upon Procedures
The Agreed-Upon Procedures outlines the requirements for a Motion Picture Company to receive its incentive from the State of Utah. The details will be in the contract but here is what you can expect once your project has been approved.
Timeline and Important Dates
- Commitment Letter
- The commitment letter states the key terms the contract will include. You have seven (7) days of receiving the commitment letter to sign and return.
- Contract
- The Contract Manager at the Governor’s Office of Economic Opportunity will send the contract to the legal film contact through DocuSign. You have thirty (30) days to review and sign the contract.
- Dates
- Commencement Date: First day of eligible spend activity
- Completion Date: Last day of eligible spend activity
- Film Incentive Request Submission: Deadline for incentive request. (Note: This is 90 days after the completion date.)
Pre-Production
Production
- Add Utah Film Commission’s Production Manager, Derek Mellus, dmellus@utah.gov and film@utah.gov to your production’s call sheet distribution list.
- Track production information in the following spreadsheets. These will be required to submit with your incentive request.
Incentive Submission
- Once Utah production is complete, submit the following required documentation to your CPA for review. The CPA must follow the instructions outlined in the Agreed Upon Procedures (See Contract) in order to receive the incentive.
- Portal Reconciliation Document
- Accounting journal/transaction records and all detail used to substantiate the qualified Dollars Left In State, remaining expenses, and State of Utah taxes paid.
- Production spreadsheets – Cast & Crew, Location, Vendor
- Certificate of Compliance
- Authorization to Disclose Records
- Provide screen capture of Utah recognition credit in project’s end credits.
- To remain in good standing with the State, please refer to the Marketing & PR deliverables section below for other requested assets & information.
- Email film@utah.gov to submit your Utah CPA’s name and email address. A login will then be created for the incentive request portal.
- If you, your accountant or your CPA have questions about your incentive request submission, please email Go Utah Compliance (utaheconcompliance@utah.gov) for assistance.
