Agreed Upon Procedures

The Agreed-Upon Procedures outlines the requirements for a Motion Picture Company to receive its incentive from the State of Utah. The details will be in the contract but here is what you can expect once your project has been approved.

Timeline and Important Documents

  • Commitment Letter
    • The commitment letter states the key terms the contract will include. You have seven (7) days of receiving the commitment letter to sign and return. 
  • Vendor Form
    • Production must sign a Vendor Form to confirm address for business communications or to change address.
  • Contract
    • The Contract Manager at the Governor’s Office of Economic Opportunity will send the contract to the legal film contact through DocuSign. You have thirty (30) days to review and sign the contract.
    • Dates
      • Commencement Date: First day of eligible spend activity
      • Completion Date: Last day of eligible spend activity
      • Film Incentive Request Submission: Deadline for incentive request. (Note: This is 90 days after the completion date.)
  • All incoming productions must have a harassment policy in place for their production. Please send a copy of your harassment policy to film@utah.gov before production begins.
  • Production must provide proof of insurance and a certificate of insurance (COI) naming the State of Utah as additionally insured (at a minimum of $1M per incident/$2M aggregate) with notice of cancellation.

Pre-Production

  • Please review the information we have posted for your production on the Film Job Opportunities and let us know if you have any changes. If you are no longer hiring Crew positions or do not want to receive Extras inquiries via the email provided, please let us know and we can remove the posting. However, if you are looking for any specific Crew or Extras positions, please feel free to submit a job.
  • Utah Crew and Vendors
    • Utah is filled with professional crew, services, and vendors that can support your production. You can search online for the people or resources you need in our Utah Film Crew & Support Services Directory.
    • To help get you started, here is a list of Utah Department Heads
    • Please refer to the Utah Department of Workforce Services’ Guidelines for Employments Status (Independent Contractors) to better understand the difference between employee v. contractor and determine how you are classifying your crew, vendor and background.
    • Only Qualified Utah Vendors are eligible to count toward the Utah dollars left in state. “Qualified Utah Vendor” means a business entity that meets all of the following conditions at the time of the qualified production activity:
      • Utah Physical Presence — The business maintains a physical commercial address in the State of Utah that is: 
        1. Open and operating for a minimum of one year prior to the date of the first qualifying expenditure or production activity.
      • Utah Registration and Compliance — The business is:
        1. Registered and in good standing with the Utah Division of Corporations and Commercial Code;
        2. Able to provide documentation of business activity, Utah resident payroll, and physical location, upon request.
      • Utah Employees
        1. Maintain at least one full-time employee working at the Utah location who is a Utah resident and receives a W-2.
      • The Utah Film Commission may grant an exemption to the vendor eligibility requirements outlined in this section if the applicant can demonstrate a clear and verifiable Utah business presence, operations, or workforce impact.
      • The Utah Film Commission reserves the right to verify operational presence, including site visits to ensure compliance with this requirement.
  • Please note, roundtrip airfare can qualify at 100% (as opposed to 50%), if acquired through a Utah travel or ticketing agency and subject to Utah Sales and Use Tax.
  • For location assistance, please refer to our Utah Film Locations Database, Permits, and Film Ready Utah resources.
  • Add Utah Film Commission’s Production Manager, Derek Mellus, dmellus@utah.gov and film@utah.gov to your production’s call sheet distribution list.

  • Opportunity for Utah Film Commission to visit your set.
  • Track production information in the following spreadsheets. These will be required to submit with your incentive request.  Please use these most current templates:

Incentive Submission

Marketing & PR

Below are requested Marketing & PR deliverables that are part of the Utah Motion Picture Incentive Program. The Utah Film Commission requests these assets & information from each production so we can help promote the project and your experience filming in Utah.

  • General welcome email from the Utah Film Commission to crew distribution list (email to be provided at the beginning of principal photography).
  • Screen capture of the Utah Film Commission recognition credit (see example)
    • Download Utah Film Commission logo (NOTE: No other logos should be featured alongside the Utah Film Commission logo)
    • Add the following language above or below the logo:

Filmed on location in Utah
with special thanks to the Utah Office of Tourism and Film

  • Access to behind the scenes footage, interviews and/or still photography (if available)
    • Images/footage highlighting Utah locations preferred (please provide any required photo/video credit)
    • Interviews with director, producer and/or other cast/crew about their filming experience in Utah
  • A minimum of 5 promotional photos/film stills from the production
  • Poster/Key Art (digital file preferred)
  • Digital copy of the completed production
  • Teaser/Trailer (downloadable link preferred)
  • Release Date (Festival, Theatrical, TV, Digital/Streaming or DVD)
  • Social Media channels or hashtags associated with the production
    • While you are filming in Utah, we encourage you to share photos from the set using #FilmUtah or tag us on Instagram or Facebook.
  • Collaborate on other promotional efforts (if applicable)
